How to ensure that arbitration is used to resolve your dispute

To ensure that arbitration is used to resolve your dispute you should nominate in your agreements:

• arbitration as the preferred dispute resolution procedure.
• the arbitration rules to be used.
• the place or venue of the arbitration (optional).
• the language of the arbitration (optional).
• the law to be used (Lex_loci_arbitri) (optional).
• the arbitrator to be used (optional)

An example of a suitable clauses is:

Any dispute or difference whatsoever arising out of or in connection with this contract shall be and is hereby submitted to arbitration
in accordance with, and subject to, the UNCITRAL Arbitration Rules
save that Mr Steve White shall be the arbitrator,
the language of the arbitration shall be English and
the place of the arbitration shall be (nominate city).
